These terms and conditions (“Terms”) govern the use of the subscription-based recruitment platform (“Platform”) provided by Usobi serviced through EOI Digital LTD (“Company,” “we,” “us,” or “our”). By accessing or using the Platform, you (“User,” “you,” or “your”) agree to comply with and be bound by these Terms. Please read these Terms carefully before using the Platform. If you do not agree with these Terms, you should not use the Platform.
1. Subscription Services:
1.1 The Platform provides recruitment-related services, including job posting, candidate search, application management, and related tools, subject to the subscription plan you have selected.
1.2 You acknowledge and agree that your subscription plan and its associated features may change over time. We reserve the right to modify, upgrade, or discontinue any part of the Platform or subscription plans with or without notice.
2. User Accounts:
2.1 To access the Platform, you must create a user account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use or security breach of your account.
3. Subscription Plans and Payments:
3.1 Subscription plans are available at different price levels, each with its own set of features and limitations. You agree to select and maintain a subscription plan that suits your needs.
3.2 Payments for subscription plans are due in advance and are non-refundable, except as expressly stated in our Refund Policy.
3.3 We reserve the right to change subscription plan prices, features, or limitations at any time. Changes will be communicated to you in advance, and you will have the option to adjust your subscription accordingly.
4. Content and Usage:
4.1 You are solely responsible for all content you post, upload, or transmit through the Platform, including job listings, candidate profiles, and other related information.
4.2 You agree not to use the Platform to post or transmit content that is unlawful, defamatory, obscene, fraudulent, or otherwise objectionable. We reserve the right to remove any content that violates these Terms.
4.3 You acknowledge that we do not endorse or verify the accuracy of the content posted by users, including job listings and candidate profiles. We do not guarantee the suitability, quality, or availability of candidates or job opportunities.
5. Privacy and Data Protection:
5.1 Your use of the Platform is subject to our Privacy Policy, which outlines how we collect, store, and use your personal information. By using the Platform, you consent to our collection and use of your information as described in the Privacy Policy.
6. Termination:
6.1 Either party may terminate your subscription and access to the Platform at any time, with or without cause,.
6.2 Upon termination, you will no longer have access to the features and services provided by the Platform, and any content associated with your account may be permanently deleted.
7. Limitation of Liability:
7.1 To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Platform.
8. Governing Law and Dispute Resolution:
8.1 These Terms shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
9. Amendments:
9.1 We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Your continued use of the Platform after such changes are posted constitutes your acceptance of the modified Terms.
By using the subscription-based recruitment platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional terms and policies referenced herein. If you do not agree with these Terms, you should not use the Platform.
10. Confidentiality of Candidate Information and Availability:
10.1 You acknowledge and agree that the information you access through the Platform regarding candidates, including their personal and professional details, is considered confidential and proprietary.
10.2 You shall use candidate information solely for the purpose of evaluating their suitability for employment opportunities and shall not disclose, share, reproduce, or distribute such information to any third party without the explicit consent of the candidate and the Company.
10.3 You shall exercise reasonable care and diligence in safeguarding candidate information from unauthorized access, use, or disclosure. This includes implementing appropriate security measures to prevent unauthorized access to your account and the candidate data you have access to.
10.4 You agree to immediately notify the Company in writing in the event of any actual or suspected breach of confidentiality or unauthorized disclosure of candidate information.
10.5 Availability information of candidates, such as their job-seeking status or availability for interviews, is considered sensitive and confidential. You shall not misuse or exploit this information for purposes other than recruitment and shall not disclose or share this information with parties not directly involved in the hiring process.
10.6 Violation of this confidentiality provision may result in immediate suspension or termination of your account, and you may be subject to legal action for any damages incurred as a result of such violation.
10.7 The Company shall not be responsible for any misuse or unauthorized disclosure of candidate information by you or any third party to whom you have provided access.
10.8 User acknowledge a penalty of $30,000 USD when breaching the client confidentality.
By using the Platform and accessing candidate information, you agree to abide by these confidentiality provisions and understand the importance of maintaining the privacy and confidentiality of candidate data.
11. Money-Back Guarantee:
At Usobi, we are committed to providing you with a successful and productive experience on our subscription-based recruitment platform. As part of our commitment, we offer a money-back guarantee for your peace of mind. We guarantee that within the first 3 months of your subscription, you will receive a minimum of 1 candidate response, with a minimum of 15 connections made. We understand the importance of candidate engagement and the value it brings to your recruitment efforts.
However, if for any reason you do not receive any candidate responses within the first 3 months of your subscription, we are more than happy to provide you with a refund minus $65 USD administration costs.
